Palmeras Terms and Conditions

1. Acceptance of Terms
By entering and using the facilities at Palmeras Entertainment ("the Venue"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. General Conduct
- Respectful Behavior: All guests are expected to behave respectfully towards other patrons and staff. Harassment, abusive language, or disruptive behavior will not be tolerated.
- Compliance with Instructions: Guests must follow all posted signs and verbal instructions from staff members.
- Age Restrictions: Minors under the age of 16 must be accompanied by an adult at all times.
3. Safety Guidelines
- Assumption of Risk: Participation in activities such as bowling, golf simulators, bocce, billiards, arcade games, hologate, 7D cinema, snook ball, foosball, and shuffleboard involves inherent risks. Guests participate at their own risk.
- Medical Conditions: Guests with medical conditions should consult a physician before participating in any activities.
- Equipment Use: Use equipment only for its intended purpose and in designated areas.
4. Liability Waiver
- Release of Liability: Palmeras Entertainment is not liable for any injuries, damages, or losses resulting from participation in any activities, except where caused by our negligence.
- Indemnification: Guests agree to indemnify and hold harmless Palmeras Entertainment from any claims arising out of their actions or omissions.
5. Damage to Property
- Guest Responsibility: Guests are responsible for any damage they cause to the Venue's property or equipment.
- Restitution: The cost of repair or replacement of damaged items may be charged to the responsible party.
6. Personal Belongings
- Security of Items: Palmeras Entertainment is not responsible for lost, stolen, or damaged personal items.
- Prohibited Items: Weapons, illegal substances, and hazardous materials are not permitted on the premises.
7. Food and Beverage
- Outside Food and Drinks: No outside food or beverages are allowed without prior permission.
- Alcohol Consumption: Alcoholic beverages are not available for purchase. Guests are not allowed to bring in water flasks or water bottles.
8. Photography and Videography
- Personal Use: Guests may take photos and videos for personal use.
- Commercial Use: Any commercial photography or videography requires prior written consent from management.
9. Refunds and Cancellations
- All Sales Final: Purchases of game credits, tickets, or bookings are non-refundable unless specified otherwise.
- Event Cancellation: Palmeras Entertainment reserves the right to cancel events or bookings with no notice and will provide appropriate refunds or rescheduling options.
10. Privacy Policy
- Data Collection: Personal information collected will be used in accordance with our Privacy Policy.
- Marketing Communications: Guests may opt-in to receive promotional materials; opting out is available at any time.
11. Amendments
- Right to Modify: Palmeras Entertainment reserves the right to amend these Terms and Conditions at any time without prior notice.
- Effective Date: Changes will become effective upon posting on our website or premises.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of NJ, United States of America, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
13. Head Count and Attendance Policy
- Final Head Count Commitment: The final head count for your event will be determined and locked in when the second deposit payment is made. This committed head count will be the minimum number of guests charged for your event, regardless of actual attendance.
- No Refunds for Lower Attendance: If fewer people attend your event than the committed head count established at the time of the second deposit payment, no refund, credit, or reduction in charges will be provided. You will be charged for the full committed head count.
- Additional Guest Charges: If more people attend your event than the committed head count, additional charges will apply for each extra person. These charges will be calculated at the same per-person rate as your original event package, regardless of whether the additional guests participate in activities or use any facilities.
- Group Association Policy: Any person who arrives as part of your group or event, whether participating in activities or not, will be counted toward your total attendance and subject to applicable charges if they exceed your committed head count.
- Payment Authorization: By providing your payment information, you authorize Palmeras Entertainment to charge the card on file for any additional guests beyond your committed head count. Palmeras reserves the right to provide photographic or other evidence to credit card companies if such charges are contested.
- No Exceptions: This policy applies to all event bookings and packages without exception. The committed head count serves as a binding agreement for minimum charges and forms the basis for all event-related billing.
14. Membership Terms
- Membership Modifications: Palmeras Entertainment reserves the right to modify, suspend, or eliminate any membership program at any time with reasonable notice to members. Notice will be provided through our website, email, or other reasonable means of communication.
- Program Discontinuation: In the event that a membership program is discontinued or eliminated, Palmeras Entertainment will honor all existing memberships for the full period for which they were purchased, regardless of the program's discontinuation.
- No Refunds Policy: All membership purchases are final and non-refundable. Memberships cannot be transferred, sold, or assigned to another person without prior written consent from management.
- Early Cancellation: Members may cancel their membership at any time; however, no refund will be provided. The membership will remain active and all benefits will continue to be available for the full period for which it was purchased.
- Billing and Renewals: Membership fees are due in full at the time of purchase. Members will be notified prior to any automatic renewal periods and may choose not to renew without penalty.
- Membership Benefits: Membership benefits are subject to availability and may be modified as part of program updates. Changes to benefits will be communicated with reasonable advance notice.
